Diane Babb Maughan

Diane Maughan litigates in Alabama state and federal courts at both the trial and appellate levels.  She also represents clients in administrative and arbitration proceedings, and in regulatory matters involving compliance with federal healthcare laws. 

Mrs. Maughan’s litigation practice includes the defense of fraud, trademark infringement, qui tam, products liability, and real property damage claims.  Mrs. Maughan regularly represents clients in business disputes, including breach of contract, breach of fiduciary duty, and business-to-business collection matters.  She has also been involved in cases relating to scientific research, including commercial research for the pharmaceutical industry and federally-funded university research.  

Mrs. Maughan handles appeals of all types of civil cases in both state and federal courts.  She successfully defended, in oral argument before the United States Court of Appeals for the Eleventh Circuit, a trademark infringement action against a local business owner brought by a national company.  Prior to joining Cabaniss Johnston, she served as a law clerk to the Honorable Perry O. Hooper, Sr., Chief Justice of the Supreme Court of Alabama. 

Mrs. Maughan obtained a Bachelor of Arts, magna cum laude, in Political Science and Environmental Studies from Baylor University in Waco, Texas, where she was inducted into Phi Beta Kappa.  She subsequently graduated, summa cum laude, from the University of Alabama School of Law, where she served on the Managing Board of the Alabama Law Review, was inducted into the Order of the Coif, was a Hugo Black Scholar, and received the Dean M. Leigh Harrison Award for graduating in the Top 5% of the class. 

Mrs. Maughan is the author of “Take Caution When Representing Clients Across State Lines: The Services Provided May Constitute The Unauthorized Practice of Law,” 50 Ala. L. Rev. 535 (1999).  She is a member of the Birmingham and the American Bar Associations, the Alabama Defense Lawyers Association, and the Defense Research Institute.  Mrs. Maughan is admitted to practice in all state and federal courts in Alabama and the United States Court of Appeals for the Eleventh Circuit.
