Health Care Law
The Firm maintains a diverse and
active health care practice, and performs legal services for a
variety of clients in the industry. The Firm’s clients include
both non-profit and for-profit hospitals, as well as nursing
homes, long term acute care hospital facilities, home health
agencies, a number of private physicians and surgeons and persons
and entities in the scientific community. The Firm also represents
the Medicaid Managed Care Organization which operates the Alabama
Medicaid Maternity Program in the eight county area in and around
Birmingham, which entity is owned by all of the hospitals in the
area which deliver maternity care. The Firm regularly provides
services such as:
- Representation of providers in
Certificate of Need proceedings
- Practice before the IRS on
behalf of non-profit providers, including obtaining exemption
determinations and Private Letter Rulings
- Regulatory advice regarding
the Stark and Anti-Kickback statutes
- Drafting and advising with
respect to physician recruiting agreements, Medical Director
agreements, employment agreements and medical staff bylaws
- Representation in licensure
and accreditation issues, medical staff disciplinary proceedings
and credentialing disputes
- Contracting and joint venture
structuring between providers, physicians and investors
- Asset acquisitions,
divestitures and facility construction projects
- Representation of physicians
in professional disciplinary proceedings
- Litigation, including:
- Defense of qui tam actions and proceedings involving Medicare
billing
- Defense of research misconduct claims incident to federal
grants
- Defense of medical malpractice actions
