R. Carlton Smyly
Carl Smyly received his undergraduate degree at Birmingham-Southern College, where he was selected into the Phi Beta Kappa honorary society and was a valedictorian of his 1979 graduating class. He then earned his Juris Doctor degree at the University of Virginia School of Law in 1982.
For over 20 years, Mr. Smyly has been assigned the highest possible Peer Review Ratings for legal ability and ethical standards in the Martindale-Hubbell Legal Directory. He has been selected by his peers for inclusion in The Best Lawyers in America in the specialties of Commercial Litigation, Construction Litigation, and Construction Law, and was selected as Best Lawyers’ 2015 Birmingham Construction Law “Lawyer of the Year.” Mr. Smyly has also repeatedly been selected as a B-Metro “Top Flight Attorney” and a Birmingham Magazine “Top Attorney” in the Construction Law practice area. In 2017, Mr. Smyly was selected as a Charter Fellow of the Construction Lawyers Society of America.
Mr. Smyly is a member of the American Bar Association’s Forum on the Construction Industry, the Construction Litigation Committee of the American Bar Association’s Litigation Section, the Construction Law Section of the Alabama Bar Association, and the Defense Research Institute. Mr. Smyly’s practice emphasizes construction law and commercial litigation. In the construction area, he has represented general contractors, subcontractors, owners, developers, lenders, program managers, consultants, architects, engineers, and manufacturers. The scope of his representation includes contract negotiations, form and procedure development, and pre-litigation dispute resolution, in addition to administrative proceedings, arbitration hearings, and bench and jury trials. Mr. Smyly has tried many construction cases in state and federal courts. He has also handled many other types of commercial lawsuits, including partnership disputes, stockholder disputes, intellectual property cases, real estate disputes, products liability cases, professional liability cases, business tort cases, and complex class actions.
Mr. Smyly was born and raised in Andalusia, Alabama, and has been married to his high school sweetheart, Celia Roland Smyly, for over 35 years. He and Celia have three adult children, Marie, Robert, and Frank. Mr. Smyly is a member of a member of the Edward Lee Norton Board of Advisors for Management and Professional Education at Birmingham-Southern College. His interests outside of the practice of law including hiking, backpacking, canoeing, and photography.
